1Check complaints before you buy

Complaints by earlier buyers are the clearest public sign of how a builder treats them: delays, refunds, missing amenities.

How to check

  1. Open the Project Wise Complaint List.
  2. Type part of the project’s name under Project Name and press Search. State and district can stay blank.
  3. Each registration has its own row and Number of Complaints. A project with several wings can have several rows.
  4. For what the complaints were about, open the project on MahaRERA (how to find it) and read its complaints.

Watch out for

  • Many complaints against wings that should already be finished.
  • Orders the builder hasn’t complied with, and recovery warrants (section 40(1)).
  • The same builder’s other projects: there is a Promoter Wise list too.

2File a complaint

A complaint is how a buyer asks MahaRERA to order a refund, interest for delay, or the builder to do what the agreement says.

How to check

  1. Register as a complainant on MahaRERA’s complaint portal. You’ll be offered MahaRERA’s Conciliation Forum, a mediated settlement: choose Yes to try it, or No to go on to the complaint.
  2. Log in and open Form A. Keep these ready: building, wing and flat number; the names of all owners; the total price; money paid till date; the booking or allotment date; the agreement date; and the possession date in the agreement.
  3. Upload the documents your complaint relies on, such as the agreement, payment receipts and letters.
  4. Pay the fee. MahaRERA emails you and the builder, and the complaint appears on both dashboards.
  5. Then submit a convenience document set of no more than 20 pages (MahaRERA Orders 23/2021 and 27/2021).

Watch out for

  • Each buyer files a separate complaint. Group complaints are only for common relief or common amenities.
  • The project must be registered. For an unregistered one, MahaRERA has a separate route: Complaint Against Unregistered Project.

3Track it to an order

Notices aren’t posted to you. Once they show on your dashboard, they count as served, so a missed hearing is on you.

What happens

  1. The registry checks the complaint and tells you of any objections to fix.
  2. It goes to a bench, and the builder can upload a reply.
  3. Hearings are listed by seniority (Circular 34/2021). At the first, if both sides agree, it can go to conciliation.
  4. After each hearing, the roznama (the record of the hearing) is uploaded. Replies and applications are uploaded the same way.
  5. When arguments end, the order is reserved, then published on MahaRERA and emailed to both sides.

Watch out for

  • You can appear yourself, or through an advocate, a chartered accountant or anyone else, with a vakalatnama or an authority letter.
  • MahaRERA may hear several complaints about the same project together.

Quick answers

How do I file a complaint with MahaRERA?

Online only. Register as a complainant on MahaRERA’s complaint portal, fill in Form A, upload your documents and pay the fee. MahaRERA then emails you and the builder.

How do I check my MahaRERA complaint status?

Log in to your MahaRERA dashboard. Hearing dates, notices, the roznama of each hearing and orders all appear there, and notices count as served once they show, so check it regularly.

How do I see complaints against a project?

Use MahaRERA’s Project Wise Complaint List: type part of the project’s name and search. It shows the number of complaints for each registration, with no login.

Can I complain about a project that isn’t registered with MahaRERA?

Yes, through a separate route MahaRERA lists as Complaint Against Unregistered Project. Form A complaints are only for registered projects.

What if the builder doesn’t follow MahaRERA’s order?

After 60 days you can apply for non-execution on the complaint portal. MahaRERA may then issue a recovery warrant to the district collector under section 40(1) of the RERA Act.

Do I need a lawyer for a MahaRERA complaint?

No. You can appear yourself, or through an advocate, a chartered accountant or anyone else, with a vakalatnama or an authority letter.
