OC and CC: full form, meaning, and how to check them for a Mumbai flat

What the Occupation Certificate and Commencement Certificate mean in Mumbai, how to check a project’s CCs on MahaRERA, what to look for in an OC, and your rights under the RERA Act.

The RERA Act defines an occupancy certificate as the certificate permitting occupation of a building under local laws, which has provision for water, sanitation and electricity (section 2(zf)).

1Check the CC on a new project

A project can sell flats on floors its permit doesn’t yet cover. That is normal early on, but a permit that stays at the basement for a long time is a question to ask.

How to check

  1. Open the project on MahaRERA (how to find it).
  2. Find Commencement Certificate / NA Order Documents Details. Each row is a CC, with its date and the document.
  3. Check the column Is CC One Year Old, and look for a later CC or renewal if it says yes.
  4. On newer pages, the building table’s CC Issued up-to (No. of Floors) shows how far the permits reach. Compare it with the sanctioned floors and with your floor.

Watch out for

  • A CC that names only the plinth or basement, with no later one, on a project selling upper floors.
  • A last CC more than a year old, with no renewal on record.
  • A sales team that can’t tell you which CC covers your floor.

2Check the OC before possession

Without an OC, the building isn’t cleared to live in. With a part OC, only the wings or floors it names are.

How to check

  1. Ask for a copy of the OC before you take possession, or before you pay for a resale flat.
  2. Check who issued it and when: it should come from the planning authority, not the builder.
  3. Check it names your building and wing, and that it covers your floor. A part OC lists what it covers.
  4. Note the date: from it, you have two months to take possession (RERA Act, section 19(10)).

Watch out for

  • Possession offered with the OC “applied for” but not issued.
  • A part OC that covers other floors or wings, but not yours.
  • For a resale flat, a building that never received an OC. Ask a property lawyer before you go ahead.

A permit that hasn’t moved isn’t proof of a problem, but it is a question for the builder before you pay.
